I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as the provider (JJ´s Food & Feed Trade GmbH) via the website www.tierfutterpro.de. Unless otherwise agreed, any general terms and conditions of your own that you may use are hereby rejected.
(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a legally capable partnership that acts in the exercise of their independent professional or commercial activity when concluding a legal transaction.

Die zum Kauf beabsichtigten Waren werden im "Warenkorb" abgelegt. Über die entsprechende Schaltfläche in der Navigationsleiste können Sie den "Warenkorb" aufrufen und dort jederzeit Änderungen vornehmen.
Nach Anklicken der Schaltfläche "Kasse" oder "Weiter zur Bestellung" (oder ähnliche Bezeichnung) und der Eingabe der persönlichen Daten sowie der Zahlungs- und Versandbedingungen werden Ihnen abschließend die Bestelldaten als Bestellübersicht angezeigt.
Soweit Sie als Zahlungsart ein Sofortzahl-System (z.B. PayPal (Express/Plus/Checkout), Amazon Pay, Sofort) nutzen, werden Sie entweder auf die Bestellübersichtsseite in unserem Online-Shop geführt oder auf die Internetseite des Anbieters des Sofortzahl-Systems weitergeleitet.
Erfolgt eine Weiterleitung zu dem jeweiligen Sofortzahl-System, nehmen Sie dort die entsprechende Auswahl bzw. Eingabe Ihrer Daten vor. Abschließend werden Ihnen auf der Internetseite des Anbieters des Sofortzahl-Systems oder nachdem Sie zurück in unseren Online-Shop geleitet wurden, die Bestelldaten als Bestellübersicht angezeigt.
Vor Absenden der Bestellung haben Sie die Möglichkeit, die Angaben in der Bestellübersicht nochmals zu überprüfen, zu ändern (auch über die Funktion "zurück" des Internetbrowsers) bzw. die Bestellung abzubrechen.
Mit dem Absenden der Bestellung über die entsprechende Schaltfläche ("zahlungspflichtig bestellen", "kaufen" / "jetzt kaufen", "kostenpflichtig bestellen", "bezahlen" / "jetzt bezahlen" oder ähnliche Bezeichnung) erklären Sie rechtsverbindlich die Annahme des Angebotes, wodurch der Vertrag zustande kommt.
§ 2 Conclusion of Contract
(1) The subject of the contract is the sale of goods.
(2) By listing the respective product on our website, we make you a binding offer to conclude a contract via the online shopping cart system on the terms and conditions specified in the product description.
(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "shopping cart". You can access the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time.
After clicking the "Checkout" or "Continue to Order" button (or similar designation) and entering your personal data as well as payment and shipping conditions, your order data will be displayed to you as an order summary.
If you use an instant payment system (e.g. PayPal (Express/Plus/Checkout), Amazon Pay, Sofort) as your payment method, you will either be directed to the order summary page in our online shop or forwarded to the website of the instant payment system provider.
If you are redirected to the respective instant payment system, you will make the appropriate selection or enter your data there. Finally, you will be shown your order data as an order summary on the website of the instant payment system provider or after you have been redirected back to our online shop.
Before sending your order, you have the opportunity to review the information in the order summary again, to change it (also using the "back" function of the Internet browser) or to cancel the order.
By submitting your order via the appropriate button ("order subject to payment", "buy" / "buy now", "order subject to payment", "pay" / "pay now" or similar designation) you declare your legally binding acceptance of the offer, which constitutes the conclusion of the contract.
(4) Your inquiries for the creation of an offer are non-binding for you. We will provide you with a binding offer in text form (e.g. by e-mail), which you can accept within 5 days (unless a different period is specified in the respective offer).
(5) The processing of the order and transmission of all information required in connection with the conclusion of the contract is carried out by e-mail, partly automatically. You must therefore ensure that the e-mail address you have provided to us is correct, that receipt of e-mails is technically guaranteed and in particular that it is not prevented by SPAM filters.
§ 3 Individually Designed Goods
(1) You provide us with the appropriate information, texts or files required for the individual design of the goods via the online ordering system or by e-mail. Any specifications we make regarding file formats must be observed.
(2) You undertake not to transmit any data whose content violates the rights of third parties (in particular copyright, name rights, trademark rights) or violates existing laws.
In the event of a breach of this obligation, you are liable to us for damages that arise to us as a result of claims by third parties that are rightfully asserted against us. This does not apply if you are not responsible for the infringement of rights.
(3) You are obliged to check the data for correctness before transmission. We do not check the transmitted data.
§ 4 Special Provisions for Payment Methods Offered
(1) Credit Check
If we provide advance services, for example in case of payment by invoice or direct debit, your data will be passed on to ETI experts GmbH, Amsterdamer Straße 133 b, 50735 Cologne for creditworthiness assessment on the basis of mathematically-statistical procedures for the purpose of safeguarding our legitimate interests. We reserve the right to refuse you payment by invoice or direct debit as a result of the credit check.
(2) Payment via Klarna
In cooperation with the payment service provider Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden; "Klarna") we offer the following payment options. Payment is made to Klarna in each case:

(3) SEPA Direct Debit
When paying by SEPA direct debit, you authorize us by granting a corresponding SEPA mandate to collect the invoice amount from the specified account.
The direct debit will be collected within 3 days after the contract is concluded.
The period for submitting the advance notification (pre-notification) is shortened to 5 days before the due date. You are obliged to ensure that your account has sufficient funds by the due date. In the event of a chargeback due to your fault, you must pay the incurred bank charge.
(4) Payment via "PayPal" / "PayPal Checkout"
If you select a payment method offered via "PayPal" / "PayPal Checkout", payment processing will be handled by the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxembourg; "PayPal"). The individual payment methods via "PayPal" will be displayed to you under a correspondingly labeled button on our website and in the online ordering process. PayPal may use other payment services for payment processing; if special payment terms apply to these, you will be informed separately. (5) Payment via "Mollie"
If you select a payment method offered via "Mollie", payment processing will be handled by the payment service provider Mollie B.V. (Keizersgracht 313, 1016 EE Amsterdam, Netherlands; "Mollie").
The individual payment methods via "Mollie" will be displayed to you under a correspondingly labeled button on our website and in the online ordering process. Mollie may use other payment services for payment processing; if special payment terms apply to these, you will be informed separately. (6) Payment via "Shopify Payments"If you select a payment method offered via "Shopify Payments", the Shopify Payments service of Shopify International Limited (2nd Floor Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland), payment processing will be handled by the payment service provider Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland; "Stripe"). The individual payment methods via Shopify Payments will be displayed to you under a correspondingly labeled button on our website and in the online ordering process. § 5 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if the claims arise from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price.
§ 6 Warranty
(1) Statutory rights of warranty for defects apply.
(2) As a consumer, you are asked to check the goods upon delivery for completeness, obvious defects and transport damage, and to notify us and the carrier of any complaints as quickly as possible. Failure to do so will not affect your statutory warranty rights.
(3) If a characteristic of the goods deviates from objective requirements, the deviation is only deemed agreed if you were informed of it by us before submitting your contract declaration and the deviation was expressly and separately agreed between the contracting parties.
§ 7 Choice of Law, Place of Performance, Jurisdiction
(1) German law applies. For consumers, this choice of law only applies to the extent that the protection afforded by the mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn (principle of more favorable terms).
(2) The place of performance for all services arising from the business relationships existing with us and the court with jurisdiction is our registered office, provided that you are not a consumer but a merchant, a legal entity under public law or public law special assets. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if the place of residence or habitual residence is not known at the time the action is brought. The right to also call upon the court at another statutory place of jurisdiction remains unaffected by this.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

2. Information on Contract Conclusion
The technical steps for contract conclusion, the conclusion of the contract itself and the possibilities for correction are governed by the provisions on "Conclusion of Contract" in our General Terms and Conditions (Part I).
3. Contract Language, Contract Text Storage
3.1. The contract language is German.
3.2. The complete contract text is not stored by us. Before sending the order via the online shopping cart system, the contract data can be printed or electronically saved using the browser's print function. After your order is received by us, the order data, the legally required information for distance contracts and the General Terms and Conditions will be sent to you again by e-mail.
3.3. For offer inquiries outside the online shopping cart system, you will receive all contract data as part of a binding offer in text form, e.g. by e-mail, which you can print out or save electronically.
4. Essential Characteristics of the Goods or Services
The essential characteristics of the goods and/or services can be found in the respective offer.
5. Prices and Payment Terms
5.1. The prices stated in the respective offers as well as the shipping costs represent total prices. They include all price components including all applicable taxes.
5.2. The applicable shipping costs are not included in the purchase price. They can be accessed via a correspondingly labeled button on our website or in the respective offer, are separately displayed during the ordering process and must be paid by you in addition, unless free shipping has been promised.
5.3. If delivery is made to countries outside the European Union, additional costs for which we are not responsible may arise, such as customs duties, taxes or money transfer fees (bank transfer or exchange rate fees), which you must bear.
5.4. You must bear the costs of money transfers (bank transfer or exchange rate fees) in cases where delivery is made to an EU member state but payment is made outside the European Union.
5.5. The payment methods available to you are indicated via a correspondingly labeled button on our website or in the respective offer.
5.6. Unless otherwise specified for the individual payment methods, payment claims arising from the concluded contract are due immediately.
6. Delivery Terms
6.1. The delivery terms, delivery date and any existing delivery restrictions can be found via a correspondingly labeled button on our website or in the respective offer.
6.2. If you are a consumer, it is governed by law that the risk of accidental loss and deterioration of the sold goods during shipment passes to you upon handover of the goods to you, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company or person not named by the business owner to carry out the shipment.
7. Statutory Rights of Warranty
The warranty for defects is governed by the provision on "Warranty" in our General Terms and Conditions (Part I).
